Supervisors finalize animal ordinance

MONTROSE - A new ordinance that will allow the Lee County Sheriff to impound vicious dogs was passed Tuesday after a third reading was waived by supervisors.

At Tuesday's regular meeting of the Lee County Board of Supervisors the issue was up for a second reading.

Specifically, the ordinance in Title 5, Chapter 10 reads, "Any dog or companion cat running at large may be apprehended by a law enforcement officer and/or may be impounded by the sheriff..."

It also reads that is unlawful for the owner of a dog or companion cat to permit such animal to attack any person or domestic animal, or to destroy property, or to permit the animal to place any person in reasonable fear of attack or injury.

Supervisor Gary Folluo asked the board after it had been approved 5-0 on the second reading to waive the third reading so the county could start the process of getting the motion enacted.

The board voted unanimously to approve the 2nd reading and then Folluo made a motion to waive the third reading which also passed unanimously. The new ordinance now needs to be published locally and then it will become effective.

When supervisors asked Lee County Sheriff Stacy Weber if he had anything to add he declined.

"Let's just get it on the books," he said.

The council also approved a third reading of a revised rabies ordinance that requires all dogs and cats to be properly vaccinated and tagged. The ordinance is now more in line with state statutes, which requires law enforcement to put down any animal that is not tagged for proper vaccination.

In other action, the board:

• voted 5-0 to replace a deputy who had resigned from the sheriff's department

• voted 5-0 to approve a final reading of a new fireworks ordinance that aligns the county with new state regulations on the dates that fireworks are allowed in the state.
