LEE COUNTY BOARD OF SUPERVISORS REGULAR MEETING MINUTES
June 27, 2022
The Lee County Board of Supervisors met at the Lee County Administration Building in Fort Madison on Monday, June 27, 2022 at 10:00 a.m.
Present: Matt Pflug, Garry Seyb, Ron Fedler, Chuck Holmes and Rick Larkin.
All votes are unanimous unless indicated otherwise.
The Board opened the meeting by reciting the Pledge of Allegiance.
Moved by Fedler, seconded by Seyb, to approve the agenda. Motion carried.
Moved by Holmes, seconded by Seyb, to approve Resolution #2022-74. Roll call: Holmes-aye, Seyb-aye, Larkin-aye, Fedler-aye and Pflug-aye.
RESOLUTION
# 2022 - 74
INTERFUND TRANSFER FROM RURAL BASIC TO SECONDARY ROADS FOR FISCAL YEAR 2021/2022
Whereas, it is desired to authorize the County Auditor to transfer sums from the Rural Basic Fund to the Secondary Roads Fund during the 2021-2022 budget year, and
Whereas, said transfers must be in accordance with Chapter 331.432 of the Code of Iowa.
Now, Therefore, Be It Resolved, by the Lee County Board of Supervisors as follows:
Section 1. The total amount to be transferred for fiscal year ending June 30, 2022 is $2,611,758.
Section 2. Within seven working days of being notified of the current amount in said Fund, the County Auditor shall order a transfer from said funds.
Section 3. Notwithstanding the provision of Section 2, of this Resolution, total transfers shall not exceed the amount in Section 1.
Section 4. Notwithstanding the provisions of Section 2, the amount of any transfer shall not exceed available fund balances in the transferring of funds.
Section 5. At the discretion of the County Auditor, fund transfers can be allocated periodically during the fiscal year depending on fund balances.
The County Auditor has determined the amount to transfer on June 27, 2022 is as follows:
Rural Basic Fund to Secondary Roads Fund $652,939.50.
Section 6. The County Auditor is directed to correct her books when said operating transfers are made and to notify the Treasurer of the amounts transferred.

RESOLUTION #2022 - 75
Resolution for Appropriations FY2022
Whereas, it is desired to make a separate appropriation for each of the different offices and departments for the Fiscal Year beginning July 1, 2022 in accordance with Section 331.434, Subsection 6, Code of Iowa.
The board shall appropriate, by resolution, the amounts deemed necessary for each of the different county offices and departments during the ensuing fiscal year. Increases or decreases in these appropriations do not require a budget amendment, but may be provided by resolution at a regular meeting of the board, as long as each class of proposed expenditures contained in the budget summary published under subsection 3 of this section is not increased. However, decreases in appropriations for a county officer or department of more than ten percent or five thousand dollars, whichever is greater, shall not be effective unless the board sets a time and place for a public hearing on the proposed decrease and publishes notice of the hearing not less than ten nor more than twenty days prior to the hearing in the county newspapers selected under chapter 349.
Now, Therefore, be it Resolved, by the Board of Supervisors of Lee County, Iowa, as follows:
Section 1. The amounts by department or office on the attached schedule are hereby appropriated to the department or office listed in the first column on the attached schedule for a period beginning July 1, 2022 through June 30, 2023.
Section 2. Subject to the provisions of other county procedures and regulations, and applicable state law, the appropriations authorized under Section 1 shall constitute authorization for the department or officer listed to make expenditures or incur obligations effective July 1, 2022.
Section 3. No department or officer shall expend or contract to expend any money or incur any liability, or enter into any contract, which by its terms involves the expenditure of money for any purpose in excess of the amounts appropriated pursuant to this resolution in with Section 331.437, Code of Iowa:
It is unlawful for a county official, the expenditures of whose office come under this part, to authorize the expenditure of a sum for the official’s department larger than the amount which has been appropriated for that department by the board.
A county official in charge of a department or office who violates this law is guilty of a simple misdemeanor. The penalty in this section is in addition to the liability imposed in section 331.476.
Section 4. If at any time during the Budget Year 2022-2023, the Auditor shall ascertain that the available resources of a department for that year will be less than said department’s total appropriation, he/she shall immediately so inform the board and recommend appropriate corrective action.
Section 5. The Auditor shall establish separate accounts for the appropriations authorized in Section 1, each of which account shall indicate the amount of the appropriation, the amounts charged thereto, and the unencumbered balance. The Auditor shall report the status of such accounts to the applicable departments and officers monthly during the Budget Year 2022-2023.
Section 6. All appropriations authorized pursuant to this resolution lapse at the close of business June 30, 2023.

Moved by Seyb, seconded by Holmes, to approve a Help America Vote Act Grant Application for $10,000 for election security. Motion carried.
Moved by Seyb, seconded by Fedler, to table approval of an employment contract with County Engineer Ben Hull, until Hull has time to look it over. Motion carried.
Moved by Seyb, seconded by Holmes, to approve a contract with Wayland Stone, LLC, for road rock at a cost of $10.00 per ton. Motion carried.
The Board held a discussion with Hull regarding a grant application with the Iowa Department of Transportation for railroad crossing improvements.
Upon recommendation of Hull, it was moved by Fedler, seconded by Seyb, to award the bid for gas for Secondary Roads, County Conservation, County Sheriff and Great River Regional Waste Authority, for FY23, to Agriland FS, Danville, in the amount of $252,021.00 and the bid for diesel to Jet Gas Corp., Houghton, in the amount of $765,393.80. Motion carried.

LEE COUNTY, IOWA
WHEREAS, Lee County is a duly organized municipality in the State of Iowa in accordance with relevant authorizing statutes; and
WHEREAS, Lee County provides certain services to its residents and businesses to maintain an excellent quality of life and an environment of prosperity; and
WHEREAS, Lee County Public Health Department and EMS is a necessary, useful, and vital service to Lee County residents and businesses; and
WHEREAS, it is beneficial to the overall economic and social good in Lee County for Lee County Public Health Department and EMS to be located in a stable, efficient, accessible, and purposeful facility; and
WHEREAS, Lee County Public Health Department and EMS is not presently located in a stable, efficient, accessible, and purposeful facility; and
WHEREAS, Lee County desires to leverage new and current resources to construct a county-owned facility that is a long-lasting, visually appealing, efficient, accessible, and purposeful for use of the Lee County Public Health Department and EMS; and
WHEREAS, Lee County shall work to allocate and secure existing and new funds through grants, ARPA funds, debt issuance, or other means, to construct a county-owned facility for the Lee County Public Health Department and EMS; and
THEREFORE, BE IT RESOLVED, on this 27th Day of June, 2022
Lee County shall spend no more than $5,400,000 on a county-owned facility, with a 10% contingency due to inflationary pressures, for the Lee County Public Health Department and EMS and endeavor to develop the project on an expedited schedule.
