FM teen gets five years probation for robbery, gun charges


FORT MADISON – A Fort Madison teen has been given five years probation after being found guilty of 2nd-degree armed robbery, trafficking in stolen weapons, and unauthorized use of offensive weapons, stemming from 2017 arrests in Fort Madison and Burlington.

8th Judicial District Judge John Wright sentenced Daymeon Jayshon Virgil, 17, to a 10-year suspended prison sentence, five years probation, and a $1,000 fine on Friday in North Lee County Court on the robbery conviction. Virgil was also sentenced for trafficking in stolen weapons and was given a concurrent five-year suspended prison sentence on that conviction, along with a concurrent five-year probation sentence, and a $750 fine.

He was also in court in Des Moines County this morning for sentencing on a conviction for unauthorized possession of offensive weapons stemming from a Burlington Police complaint in March of last year. 8th District Judge William Dowell sentenced Virgil to a suspended five-year prison term and placed him on five years probation with a $750 fine and 80 hours of community service.

Virgil was accused of robbing the Garner Oil gas station on Jan. 7 at gun point, along with Noah Gasaway, 18, of Fort Madison, who is also facing charges in connection with the robbery. Gasaway was charged with first-degree robbery, and two counts of using a juvenile to commit an indictable offense. Gasaway has a trial tentatively set for April 17 in North Lee County Court.

Lee County Attorney Ross Braden said Virgil’s hearing was a contested sentencing and he was asking for a term in prison.

“I was arguing for incarceration. He was 16 at the the time the crime was committed, but if he had been 18 it would have been mandatory prison.”
